The District Judge has primary jurisdiction in all cases and proceedings. In practice, this means:

  • Criminal Cases — felonies are handled by the District Judge; misdemeanors usually start with the Magistrate Judge
  • Civil Cases — claims without a monetary limit are handled by the District Court; small claims up to $5,000 are handled by the Magistrate Judge
  • Family Law — divorces, custody, alimony, protective orders are processed by the Magistrate Division
  • Probate Cases — wills, estate management, guardianship — also through the Magistrate Judge
  • Traffic Violations — fines, traffic violations are handled by the Magistrate Judge

The Judicial Branch of Idaho is organized such that district courts are courts of general jurisdiction in each of the state's 44 counties. Bankruptcy cases from Latah County are handled by the federal Idaho Bankruptcy Court through the PACER system.
